Originally published in 1963, this classic book is a rethinking of the history of Western political philosophy. Charles N. R. McCoy contrasts classical-medieval principles against the "hypotheses" at the root of modern liberalism and modern conservativism. In Part I, "The Classical Christian Tradition from Plato to Aquinas," the author lays the foundation for a philosophical "structure" capable of producing "constitutional liberty." Part II, "The Modern Theory of Politics from Machiavelli to Marx," attempts to show, beginning with Machiavelli, the reversal and (...) destruction of the pre-modern "structure" postulated in Part I. McCoy stresses the great contributions of Aristotle to political thought found in his more familiar Ethics and Politics, but also includes key insights drawn from Metaphysics and Physics. These contributions are developed and perfected, McCoy argues, by Augustine and Aquinas. Two other important features include McCoy's epistemological insights into Plato's work that will be new to many readers and the author's juxtaposition of traditional natural law with "the modernized theory of natural law." The modern account of autonomous natural law, in McCoy's view, helps explain the totalitarian direction of key aspects of modern political thought. There are those who take Nietzsche seriously as a philosopher and study his works for their own sake, while others seek to mine his works for philosophical gold to determine what he might have (...) to offer their particular area of specialization (and sometimes these objectives overlap). On the other hand, there are those who seek to sensationalize Nietzsche by making him out to be a caricature or buffoon of sorts—far less deserving of the kind of seriousness we reserve for other figures such as Descartes or Kant. Instead, Nietzsche's philosophical legacy is colored by his ill health, alleged homosexuality, or "madness." Some recent biographies have only perpetuated the caricature. Fortunately, Small's book is not one of them.Small aims to explain the philosophical relationship between Nietzsche and Rée. Nietzsche's background is well known, while Rée's life has received only slight attention from scholars. Although he did not self-identify as Jewish, Rée was born into a wealthy Jewish family, which afforded him the luxury of attending several different German universities. After studying law, psychology, and physiology, he finally settled on philosophy. By the time Rée met Nietzsche, he had already defended a dissertation on Aristotle's ethics and published his first book, Psychological Observations, in 1875.Throughout the book, Small subtly fuses the personal with the philosophical without weakening the philosophical substance of Nietzsche's or Rée's ideas. In explaining Rée's influence on Nietzsche during the seven years of their friendship, Small accomplishes several objectives.First and foremost, Small illuminates the development of Nietzsche's thought from 1875 until 1882. It was during these years that Nietzsche published Human, All Too Human (1878; the first supplement to the book was published in 1879 and the second in 1880), Daybreak (1881), and The Gay Science (1882). More importantly, Small demonstrates the nexus between these works and Rée's Psychological Observations (1875) and The Origin of Moral Sensations.During the winter of 1876–77, Nietzsche and Rée lived together. At this time Nietzsche began writing Human, All Too Human, while Rée wrote The Origin of Moral Sensations. Nietzsche turned to Rée's Psychological Observations for headings for his own Human, All Too Human. Thus, "'On Religious Things' became 'The Religious Life,' while 'On Woman, Love and Marriage' became 'Woman and Child'" (28). A cross-cultural survey experiment revealed a dominant tendency to rely on a rule’s letter over its spirit when deciding which behaviors violate the rule. This tendency varied markedly across (k = 15) countries, owing to variation in the impact of moral appraisals on judgments of rule violation. Compared with laypeople, legal experts were more inclined to disregard their moral evaluations of the acts altogether and consequently exhibited stronger textualist tendencies. Finally, we evaluated a plausible mechanism for the emergence of textualism: (...) in a two-player coordination game, incentives to coordinate in the absence of communication reinforced participants’ adherence to rules’ literal meaning. Together, these studies (total n = 5,794) help clarify the origins and allure of textualism, especially in the law. Within heterogeneous communities in which members diverge in their moral appraisals involving a rule’s purpose, the rule’s literal meaning provides a clear focal point—an identifiable point of agreement enabling coordinated interpretation among citizens, lawmakers, and judges. The faithfulobservance of the traditional laws in the studyarea was attributed to the fact that Awka-Southarea had remained occupied by the same peoplefor centuries. The study showed that thepreserved forests and their shrines in Nibotown have largely remained intact. In Nisetown, (...) however, with nine shrines still inexistence, the rules have relaxed a little,mainly because they embraced modernization. Inthis town, the fringes of the forests may beused for farming but no felling of trees wouldbe allowed. The ``god'' of the shrine in Obunaguvillage was much revered until the advent ofChristianity. This religion has had an erodingeffect on the taboos, which were put in placeto protect their forests and streams. Theabandonment of traditional cultural practicesis doing harm that goes beyond the abrogationof traditional cultural practices to seriousthreat to natural environmental structures. Thecultures of the different tribes in Nigerianeed to be revisited for evaluation and studiesto enable their integration into modernpractices that will make the environment moresustainable. Writers on jurisprudence often stress that conflict between positive laws and morality does not invalidate the positive laws. A law which requires me to compensate another for an injury caused by a dangerous object kept on my property is not invalidated by the fact that I have not been negligent and have no moral obligation to compensate the injured person. And although I have a moral obligation to keep my promises, positive laws may validly imply that I need not keep (...) promises not made for a consideration or under seal. Thus positive law may permit acts not permitted by morals and may forbid acts permitted by morals. The lesson drawn from these thoughts is that to establish a positive law as valid we need not consider the relationships it bears to the rules of morals. A valid law is simply a law created in accordance with the constitutional conventions or ‘rules of recognition’ of the society in which it is to be applied. It is the manner of its establishment, not its relationship to morals, which makes a law valid. (shrink)

Rapid developments in Artificial Intelligence are leading to an increasing human reliance on machine decision making. Even in collaborative efforts with Decision Support Systems (DSSs), where a human expert is expected to make the final decisions, it can be hard to keep the expert actively involved throughout the decision process. DSSs suggest their own solutions and thus invite passive decision making. To keep humans actively ‘on’ the decision-making loop and counter overreliance on machines, we propose a ‘reflection machine’ (RM). This (...) system asks users questions about their decision strategy and thereby prompts them to evaluate their own decisions critically. We discuss what forms RMs can take and present a proof-of-concept implementation of a RM that can produce feedback on users’ decisions in the medical and law domains. We show that the prototype requires very little domain knowledge to create reasonably intelligent critiquing questions. With this prototype, we demonstrate the technical feasibility to develop RMs and hope to pave the way for future research into their effectiveness and value. (shrink)

Firearm injury in the United States is a public health crisis in which physicians are uniquely situated to intervene. However, their ability to mitigate harm is limited by a complex array of laws and regulations that shape their role in firearm injury prevention. This piece uses four clinical scenarios to illustrate how these laws and regulations impact physician practice, including patient counseling, injury reporting, and the use of court orders and involuntary holds. Unintended consequences on clinical practice of laws intended (...) to reduce firearm injury are also discussed. Lessons drawn from these cases suggest that physicians require more nuanced education on this topic, and that policymakers should consult front-line healthcare providers when designing firearm policies. Realities of the formed information society made actual for inclusive education a problem of formation of professionals of the new directions capable to apply information technologies to improvement of interaction between participants of process of distance learning. Until recent time the institute of distance learning had no analogs in our educational system. It has to become one of the most important elements of the organization of remote education. Inclusive education becomes the new strategic direction of modern education in Russia, its (...) program of development to 2020 is designated by the Federal law ‘About the education in the Russian Federation‘ which has come into force on September 1, 2013. Ideas of inclusive training were born from a pressing need of society to help children to be integrated with features of development into society. Without it a creation of a new civilized society, the education system that meets the requirements of the humanistic principles is not possible. In this connection, creation of a substantial and technological basis of the organization of inclusive education of children in the mode of distance learning is an extremely important for today social, moral and pedagogical problem. In its center are the development of the subject, granting equal opportunities to each pupil to build the individual educational trajectory, culturological cultivation of the person capable to take an independent position in relation to external conditions. Distance learning serves as strong and active technology of socialization of such children. However, in the theory and a technique of training, the problem of distance learning of children with disabilities is insufficiently solved that is caused by unavailability of most of teachers to apply these technologies. There is a contradiction between objective practical need of distance learning for children with disabilities and insufficient readiness of a theoretical and technological basis. This is a main problem discussed in the study. In theoretical plan, it is a problem of development of the practical-focused theoretical and technological basis of distance learning of children with disabilities. On the practical level, it is a problem of formation of the subject information and education environment, designing of the contents, definition of methods, pedagogical technologies, the conditions of formation promoting achievement of the planned educational results and development of cognitive independent activity without prejudice to health of children on the basis of the accounting of their individual abilities. Technological effectiveness of the purposes is provided with prediction of educational results, their expression through requirements to actions of pupils. Recent time, children only start studying and mastering remote technologies therefore, first of all, they have to seize rational ways of educational activity and learn to work with information, i.e. priority value has to be allocated for formation of informative and logical and informative and information universal educational actions. Cohen possessed the rare combination of abstract philosophical acumen and the ability to put his thought into practice. The federal government is funding a sea change in health care by investing in interventions targeting social determinants of health, which are significant contributors to illness and health inequity. This funding power has encouraged states, professional and accreditation organizations, health care entities, and providers to focus heavily on social determinants. We examine how this shift in focus affects clinical practice in the fields of oncology and emergency medicine, and highlight potential areas of reform.

Firearm violence in the United States produces over 36,000 deaths and 74,000 sustained firearm-related injuries yearly. The paper describes the burden of firearm violence with emphasis on the disproportionate burden on children, racial/ethnic minorities, women and the healthcare system. Second, this paper identifies factors that could mitigate the burden of firearm violence by applying a blend of key ethical theories to support population level interventions and recommendations that may restrict individual rights. Such recommendations can further support targeted research to inform (...) and implement interventions, policies and laws related to firearm access and use, in order to significantly reduce the burden of firearm violence on individuals, health care systems, vulnerable populations and society-at-large. By incorporating a blended public health ethics to address firearm violence, we propose a balance between societal obligations and individual rights and privileges. (shrink)

Consideration of the property of action is proposed to provide a more meaningful definition of efficient energy use and sustainable production in ecosystems. Action has physical dimensions similar to angular momentum, its magnitude varying with mass, spatial configuration and relative motion. In this article, the relationship of action to thermodynamic processes such as the spontaneous increase in entropy of the second law is explained and the utility of action for measuring changes in energy and material distribution is promoted. In particular, (...) the view that increases in entropy and action are equivalent to disorder is challenged. Given that the development of action states may be assigned an economic value and the various sources of free energy assigned a price, action theory may provide a novel mechanism for the economic allocation of resources. This paper discusses the semiotic dimension of patent interpretation. Patent documents are at the same time disclosure of information and a granting of rights. The claim section expresses the granted rights. In this paper, we view the claims as signs that express the granted rights. The semantics to interpret the signs is given by the all-elements rule, as pragmatics. The description and drawings sections of the patent document provide metapragmatics in the form of lexicon and syntax to help the understanding (...) the claims as signs that express the granted rights. This semiotic approach for patent interpretation has important practical consequences to the correct structuring of a patent document. We highlight this contribution through an instance of a patent application in which a claim includes examples of use. Examples are not allowed in the claim text, as examples do not describe the invention, but consist of metapragmatics to better understand the invention. In this way, examples consist of metapragmatics and belong to the description section of the patent, which has the goal to facilitate the understanding of claims. In the patent application used to highlight our semiotics approach for patent interpretation, the examples initially presented in the claims were rephrased in the final granted patent, significantly reducing the scope of the claim. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)
